Terms and Conditions
1. Our contract
All bookings are made directly with @thelosttwo. By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.
2. Validity
Dates and itineraries are valid until 30 October 2020. Beyond 30 October 2020, dates and itineraries are indicative only.
3. Down Payment requirement
All trips, unless otherwise stated, offer you the chance to reserve your spot with a deposit when booking at least 60 days before departure. You are required to pay a $300 deposit payment per person per trip for your booking to be confirmed. Full trip payment is due no later than 60 days before departure. Failure to pay your trip balance on time will result in the loss of your deposit and seat on your trip. All trips/deposits are nonrefundable. If your booking is made within 60 days of the departure date then the full amount is payable at the time of booking.
4. Acceptance of booking and final payments
If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 7 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 60 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.

Prices are all presented in USD.
6. Your details
In order for us to confirm your travel arrangements, you must provide all requested details prior to trip start. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.
7. Cancellation by the traveler
If you need to cancel your booking with us, you will need to notify us in writing (by e-mail). If you cancel your booking, the following charges will apply: Cancelation fee $400 USD per booking/destination.For cancellations received less than 60 days prior to departure full payment will be lost. No cancellation fees will be waived as a result of the following:Injury or sickness.Delayed, rescheduled or missed flights.Climatic, social or political problems. If the customer finds any aspect of the tour unsatisfactory and requests any form of a refund, the customer must contact @thelosttwo via email at hello@thelosttwo.coml during the duration of the tour. If the complaint is lodged after the tour has concluded, no refund will be given. Any part of the tour that the customer finds unsatisfactory is not subject to refund. You may be able to have any cancellation fees refunded by your Travel Insurance – subject to their terms.
8. Cancellation by us
We may cancel a trip for any reason up to 60 days before departure. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
9. Minimum group size
All itineraries listed are proposed and are subject to a minimum of four bookings for each trip. Should the number of persons joining each trip be less than four, we have the right to adjust the itinerary, accommodations and all other arrangements listed within.
10. Inclusions
The price of your trip includes: All accommodation as listed, All transport listed, All activities as listed,Sightseeing and meals as listed, The services of trip leaders.
11. Exclusions
The price of your trip does not include: International or internal flights unless specified, Meals and Beverages other than those specified, Visa and passport fees, Travel insurance, Optional activities and all personal expenses.
12. Age & Health requirements
You must be at least 18 years of age on day 1 of your trip to travel with us. It is your responsibility to ensure that you are suitably fit to allow full participation in the trip and to obtain proper and detailed medical advice for the latest health requirements and recommendations for your destination. Where you do not do so and are either not allowed to enter any country or suffer personal injury as a result, we have no liability to you for any loss or damage which you suffer.
13. Small groups & combination trips
Our trips are guaranteed to depart once they have one fully paid traveler unless minimum group size specifically states otherwise. This means at times we can have groups with small numbers of travelers. If you would like to know how many people are booked on your trip or any combination trip it is part of please ask prior to making your booking.
14. Passport and visas
You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. If you need any help, or advice, with this just email us at hello@thelosttwo.com. Your passport must be valid for 6 months beyond the duration of the trip.It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip.We cannot be held responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
15. Travel insurance
You agree and acknowledge that in order to participate on any of our trips, travel insurance is required. The insurance that you obtain must adequately cover you for medical expenses, accidents, property loss, and curtailment or cancellation of your trip. Such insurance is not included in your payment to us. Proof of insurance is required no later than 1 month prior to the start of the trip or we reserve the right to cancel your reservation.It is mandatory that all attendees obtain travel insurance with a minimum coverage of $200,000 USD while traveling with us. Such insurance must cover personal injury, medical expenses, loss of or damage to luggage, repatriation expenses, and evacuation expenses.
16. Flexibility
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
17. Change of itinerary
While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. Before departure: If we make a major change, we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least a full day in the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered. After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
18. Traveller safety/expulsion
Our group trips are run by us. Our decision is final on all matters likely to affect the safety or well-being of any traveler or staff member participating in the trip. We reserve the right, in our absolute discretion, to expel attendees whose statements, acts, or omissions threaten the safety of themselves or others. Expelled attendees will not be entitled to a refund, will be responsible for any costs they must incur as a result of such expulsion, including without limitation, replacement accommodations and return travel, and may be subject to liability for any harm or damages arising out of their statements, acts, or omissions. You agree and acknowledge that Claudia & Kaan of @thelosttwo are under no legal duty to expel attendees and are not responsible for the conduct of attendees.
19. Acceptance of risk
You acknowledge and agree that participation in activities, such as adventure travel, involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. You agree that you have considered the nature and extent of the risks involved and voluntarily choose to assume all such risks, both known and unknown, even those risks that result from the negligence of others and assume full responsibility for your participation in such activities.You agree to indemnify, defend, and hold harmless Claudia & Kaan of @thelosttwo, its affiliates, officers, directors, employees, agents, services providers and licensors from and against all losses, liabilities, costs (including, without limitation, attorneys’ fees and costs on appeal or at trial), damages, judgments, claims, of every kind and nature, to the fullest extent permitted by law, arising from or relating in any way to (i) your use of the Site, (ii) products or services you have purchased through the Site, (iii) your breach of these Terms or the documents referenced herein, or (iv) your violation of any law or the rights of any third party.
20. Limitation of liability
We cannot be held responsible for any loss as a result of failure of any third-parties (including Airlines, Tour Operators & Hoteliers). We are not liable for any personal injury, death, damage, loss, accident, or delay which may be occasioned either by reason of any defect in any vehicle. We are not liable for any personal injury, death, damage, loss, accident, or delay which may be occasioned through the default acts of any company, or person, engaged in conveying you, or carrying out the arrangements of the tour, or otherwise, in connection therewith.
21. Optional activities
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.
22. Claims & complaints
If you have a complaint about your trip please inform us at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.
23. Severability
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
24. Photos and marketing
By participating in @thelosttwo group trip, you consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers.Information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip.We won’t ever e-mail you, unless it’s for a necessary, legitimate reason.We won’t give your e-mail address or personal information to anyone else.We take appropriate technical and organizational measures that are intended to prevent unauthorized or unlawful processing of personal data and accidental loss or destruction of, or damage to, personal data.If you believe that any of your personal data, which we are processing, is inaccurate, or incorrect, please contact us immediately.
25. Privacy policy
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip.
26. Applicable law
These Terms and Conditions are governed by the laws of Canada and will be interpreted in accordance with the Canadian courts. The Canadian courts shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these terms and conditions.
